課程概述

黑格爾生前出版的最後一部著作全名為《法之哲學之綱要或自然法與國家學綱領》（Grundlinien der Philosophie des Rechts oder Naturrecht und Staatswissenschaft im Grundrisse），簡稱《法哲學》（Philosophie des Recht），討論意志、自由與法的概念所構成的「客觀的精神」（objektiver Geist）的領域。所謂「客觀的精神」是指人類精神的「客觀」的部分，裏面的內容如法律規範，道德良知，家庭的婚姻、財產與養兒育女，社會的供需體系、運作方式與社會組織，國家的公權力與對外主權等等，涵蓋了現代學術裏的法律學、倫理學、社會學、經濟學、政治學、國際關係等科目所討論的範圍。用現代學術的分科方式來看，黑格爾哲學裏的「法」或「客觀的精神」相當於社會科學的領域。這部作品分三部分：「抽象法」、「道德」與「倫理」。本課程討論《法哲學》的「序言」、「導論」，以及第一部分「抽象法」的三個章節「所有權」（das Eigentum）、「契約」（der Vertrag）與「不法」（das Unrecht）。
